    Even though, Colombia has enough legal tools to rightfully defend their products through the mechanism of Protected Designation of Origin to the eyes of the Andean Community and the World Trade Organization, it shows that it is a tool that's either now well known or barely executed by a few to protect the cultural legacy of our products. The true intention of this research is to develop an historical study or the origins of industrial Property as a tool of protection for alimentary products according to their origins, following the historical evolution of the international regulations on the matter to end up with an study of the legal precepts that guard and defend the Protected Designation of Origin as a legal tool in Colombia.

    La carta de crédito y el crédito documentario frente a la normatividad local e internacional

    The documentary credit or letter of credit is a conditional payment commitment assumed by the importer's bank in favor of the exporter, according to instructions received from his client (Cadena and Cubillos, 2006: p, 162). It is considered as the most secure means of payment (Ruiz, 2003: p, 1). The exporting company will charge at the agreed time, provided it presents documents in compliance. There are a number of incompatibilities in this means of payment at the national and international level, Colombian regulations establish it as an agreement that may be revocable contrary to international regulation. Faced with these differences, the international arbitration tribunals have had the task of solving the conflicts that have been present in these globalized contracting. Colombian law has a standard for this type of transactions, but allows the use of international standards, leaving it to the arbitration of those involved, being the contract law for the parties.

    El concepto de jurisdicción en la Jurisprudencia del CIADI a partir de los casos en contra de los estados latinoamericanos 1999-2013

    En el Convenio de Washington (o también conocido como Convenio del CIADI),2 se encuentran los requisitos que se deben reunir con el fin de que el CIADI, pueda determinar si tiene jurisdicción, con el fin de que pueda llevar a cabo el procedimiento de arbitraje de inversiones entre Estados Contratantes y nacionales de otros Estados Contratantes, el problema radica en que estos requisitos no se están definidos, por lo que se presentan inconvenientes a la hora de determinar la jurisdicción del CIADI en razón de la materia. El CIADI, mediante su desarrollo jurisprudencial, ha venido dando claridad a los diferentes ejes que abarcan la jurisdicción del Centro. Es por esto que mediante esta investigación se intenta identificar a partir del desarrollo jurisprudencial las sentencias más relevantes y de esta forma hacer una reconstrucción sobre el concepto de jurisdicción.

    In a globalized world, constantly advancing with new openings and interactions in the market, it has been necessary the creation of Mechanisms that solve the potential conflicts that may arise among the diverse actors as a consequence of their global interaction, taking great relevance the international arbitration, given that from this one, solutions are given in an expeditious manner to the disagreements of the parties in litigation, observing in this one, that on numerous occasions the decree and enforcement of Precautionary measures can get to ensure Compliance of the ordered through the arbitration award, the present paper then, seeks to analyze within the framework of the Pacific Alliance the Precautionary measures proffered by a court of international arbitration, the normativity through which they are regulated, the binding force, the mandatory application of these measures through mechanisms of judicial cooperation and the conclusions that can be reached, acquiring foundations that can determine the suitability of the Mechanisms of application of the mentioned measures in Colombia.

    The post-conflict context in which we are, meaning the peace building process that seeks end of the armed conflict, using political and legal strategies for the reconstruction of the social fabric, where the private sector plays a key role, since the act of governing, known as governance and Corporate Social Responsibility (CSR) the company can meet the basic needs of society, protect human rights and work for achieving peace, as the business should not be limited to the development of classical freedoms.

    Despite the normatives advances that have surged regarding the regulation of the international franchise contract and the studies that about the industrial property protection have developed in their environment, yet exist any legals divergences that allow that arising differents inconvenients emanated of the interpretatives discussions about the legal framework applicable for the industrial property protection and that in many occasions achieve weaken the economics ralations that in the market crop up in consequence of this contrats. It is therefore that the present investigation pretended performs a study of the normativity regulatory of mentioned topics, the conceptualizations and more accepted doctrinaires reviews on the issue demarcating the field of study to the frame of the Comunidad Andina de Naciones.

    This article intends to study the legislative, doctrinal and eventually jurisprudential responsibilities to be incurred by the administrators of the commercial companies; concretely when they violate the duties stablished by legal and statutory laws that have been previously imposed. Their position as administrators plays a vital importance, not only for accomplishing its company purpose, for the common and individual interests of the members, but in terms of the impact to come by their decisions within and outside the company, also in terms of the repercussion that those decisions may cause on third parties outside the interests if the company and society; therefore is necessary expressly to stablish which one and how far extends the responsibility of the administrators against the harmful effects at any given time their activities inherent to environment in the Colombian society.

    Régimen de la insolvencia transfronteriza: Colombia, Ecuador, Perú y Panamá

    A partir de las relaciones comerciales entre Colombia y sus principales socios, Ecuador, Perú y Panamá, se evidencia la configuración de casos de insolvencia transfronteriza. Al hacer un análisis del derecho interno de cada uno de estos países notamos que las normatividades internas se quedan cortas al momento de resolver este tipo de controversias entre particulares de diferentes estados, lo que al final conlleva repercusiones que afectan la economía de los estados involucrados puesto que la seguridad jurídica es la mayor afectada. La adopción de la Ley Modelo de la CNUDMI sobre insolvencia transfronteriza, se convierte en estos casos un camino sugerido a seguir para la solución de este tipo de conflictos.
