Y C(2018-09-28) Lozano Escorcia, Yon Jader; Meléndez Cuentas, Eucaris Isabel; Acosta Castro, Juan GabrielThe Bazurto market, Cartagena's main supply center, as well as all the market places, produces large volumes of solid waste, which contribute to environmental pollution and the environmental deterioration of the sector, given the effect of the air due to bad odors generated by the contamination of solid organic waste, landscaping, water by the discharge of these to the sewerage system, which has a negative impact on communities, given that they cause health problems and deteriorate their standard of living. This environmental problem, caused by pollution from the mismanagement of solid waste, involves communities and political decisions, which are often controversial and therefore very difficult to resolve, however a responsibility and knowledge must be assumed. the possibilities that exist to protect and improve the environment. According to Durán (sf), in a study carried out by ECLAC (Environmental Policies and Sustainable Development), the main actors of the waste policy are the government, businessmen and the population, the latter being the most determining , due to its demands for a better quality of life, which forces governments and businessmen to seek7 solutions to problems, based, today, on legal aspects where a regulatory framework is established with laws, regulations and norms that regulate the behavior of the economic agents and of the population and at the same time the control and supervision activities of public institutions with some responsibility in this matter
- PublicaciónAcceso abiertoLa noción de víctima a la luz de la jurisprudencia de la corte interamericana de derechos humanos(2018-06-14) Molina González, Yosimar; Acosta Castro, Juan GabrielThe victims throughout history have been at the center of the world debate, in which the defense of them has been promoted through the promulgation of normative instruments and the strengthening of judicial institutions for the sanction of the States. Thus, in the resolution of legal problems, the Inter-American Court of Human Rights (hereinafter IACHR), as an international judicial tribunal legitimized to apply and interpret the American Convention on Human Rights, has conceived that the concept of victim implies an injury of human rights by the States Parties, recognized in a judicial decision; conception that has transcended the recognition of relatives as indirect victims, under the assumption of the functional balance between the exercise of power and the guarantees of obligations, both negative and positive of the States, for individuals and for entire populations. From this perspective, in the present work the conception of collective victims will be addressed from the jurisprudence of the IACHR, and for that purpose an analysis of the judgments that this Court has issued on the subject will be made, reviewing what has been said about it and the evolution in its conception.

El desarrollo desde la perspectiva de la consulta previa frente a los ODS.(Universidad de San Buenaventura, 2021-09-30) Pineda Ortiz, Alexandra; Acosta Castro, Juan Gabriel; GIELACID - Grupo de Investigación de la Escuela Latinoamericana de Cooperación y DesarrolloLa presente investigación se realizó usando como metodología una revisión descriptiva y bibliográfica, partiendo por hacer un relato histórico del concepto moderno de desarrollo construido después de la segunda guerra mundial, su paso a la “sostenibilidad” y la construcción de los Objetivos de Desarrollo Sostenible (ODS). Este concepto predominó e influyó en la construcción de las políticas de gobiernos, instituciones y empresas, que por sus implicaciones al medio ambiente han generado conflictos en los territorios y en especial con las comunidades étnicas, que las ven como una amenaza para su cultura, saberes y para su propia pervivencia. Desde la perspectiva de la Consulta Previa, derecho fundamental para la participación de las comunidades ancestrales en la toma de decisiones cuando de intervenir sus territorios se trata, se analiza la forma como el desarrollo sostenible se lleva a la práctica frente a la implementación de los ODS, aspecto que hace evidente la necesidad de explorar un nuevo modelo de desarrollo que mejore la relación de los seres humanos y con la naturaleza, por lo que se pone de presente el contexto internacional del Buen Vivir como una alternativa a la sostenibilidad.
