    The purpose of this study was to analyze the effects of the SU 230 of 2015 in the system that regulates the transition regime in pensions, seeking to determine from the jurisprudential analysis, whether or not this decision is in accordance with the existing norms. Obeying a qualitative research with socio-legal approach. In this regard, it could be found that the granting of the pension has been recognized as a right based on a set of fundamental principles, which is why it is embodied not only in the Constitution, but also in a whole legal system, which has sought to regulate everything the process and the requirements to achieve it. Judgments issued by the Constitutional Court have influenced how judges decide on this issue, however, in some cases these sentences may lead to possible violations of the law, such is the case of public servants covered by the law transition regime.
