    This article is part of a research that aims to analyze the dynamic load test in contracts for carriage of goods under the bill of lading document, considering the effect of the new General Code of Procedure in Colombia. It aims to give a tour of the international and national legislation governing the issue, the rulings of the Constitutional Court and the opinions of the writers to confront the functionality of the document called Bill of lading or B / L and the evidentiary importance. Then there will be a proposal to solve the problems encountered.

    In Colombia the theory of dynamic burden of proof , has it had an incipient regulatory application as this is regulated by civil legislation, but this is a figure that has been introduced limited to other legislation manner so as homepage administrative law with the development of the State Council, then a decision is made on this issue by the Supreme Court in the workplace , to finalize its application in criminal law where this has been controversial since it puts in opposition constitutional Court and constitutional way under the theory of living law rights, could give a constitutional interpretation of this theory in the various legislations.
