It presents how quantities of projects and homes consist of an environmental management plan to mitigate impacts in the environment in which the construction will be carried out, but it is faced with the long-term situation that its residents are affected by the lack of comfort in the housing and high temperatures in the area opting for fast and inexpensive solutions with artificial mechanisms, such as fans and air conditioners. Buildings are presented implementing artificial cooling with another using ventilation chimneys, comparing results in costs and effectiveness to see which one is the most suitable for the inhabitants of the city of Cartagena.

Nowadays, the construction sector is of great importance from the economic point of view and at the same time it is one of the ones with the greatest environmental impact, it lacks much knowledge and tools to promote an adequate environmental management in civil works. . For this reason, it is now necessary to provide the construction sector with basic aspects to ensure that the projects generate the minimum negative impact and that above all these can be managed and minimized.

Without good management of these wastes, impacts on ecosystems and environmental degradation would be catastrophic. In order to study these impacts generated to the environment, the environmental management system emerges as a tool to assess the damages, in addition to ensuring the proper use of natural resources, preventing or mitigating environmental problems, trying to achieve sustainable development. The purpose of this article is to compile the existing legal framework in Colombia and Spain that are focused on sustainable development, bioclimatic policies, especially the management of construction and demolition waste in order to compare them, reaching the conclusion that in Colombia the Laws are obsolete, outdated, without continuity between them
