- PublicaciónAcceso abiertoEndoso en usufructo de un pagaré: análisis legal y doctrinal sobre su procedencia y legitimación(Universidad de San Buenaventura, 2019) Noguera Toro, Kevin Daniel; Vásquez Restrepo, Juan Camilo; López Restrepo, JulietaIn Colombia, the legal regime of negotiable instruments does not expressly contemplate the legal possibility of lien such instruments with usufruct, as it does with respect to other mercantile goods such as shares, however, such figure is not prohibited either, so it is possible to analyze the characteristics of those instruments to determine if they are compatible with the usufruct. However, even accepting that it is possible to lien a promissory note with usufruct, several questions arise regarding the legitimation of the legitimate holder of said instrument, especially about the way in which it can be made effective by judicial means, since it is not clear if a compulsory joinder with the legal owner, or on the contrary, the beneficial owner can demand the negotiable instrument independently, generating legal uncertainty due to unsureness. In this report, it is proposed, first, to analyze the legal possibility of endorsing in usufruct and, later, to elucidate the characteristics of the legitimate holder's legitimacy of a promissory note endorsed in that way, through observation of the law and doctrine.
- PublicaciónAcceso abiertoEl rol de la democracia deliberativa y su ejercicio legítimo(Editorial Bonaventuriana, 2014) Castillo Castillo, María LilianaEl presente texto, derivado de proceso de investigación, busca dejar elementos para el debate en torno a la construcción de la democracia deliberativa procurando establecer cuál podría ser el marco teórico en el que se puede ajustar el caso Colombiano. Para tal fin, el texto presentará: Un aparte para el debate en torno a la democracia deliberativa como procedimientos de legitimación de decisiones, estableciendo cuál es el papel de los tribunales constitucionales en la construcción de este tipo de democracia; segundo, ahondar con especial énfasis en las decisiones de la Corte Constitucional, si permiten o no, un espacio abierto para la democracia deliberativa; y tercero, se presenta un aporte al debate académico, en torno a la situación actual en Colombia en la construcción de una democracia deliberativa.

Ciudad Don Bosco(2019) Barrada, Zuleima Astrid; Arias Orozco, Édgar de JesúsThis research focused on making an understanding of the approaches, meanings and senses of the norm that young people of the Ciudad Don Bosco Education center, build from their being in the world, reading its possibilities and forms of relationship with respect to norms. How young people approach and respond to norms is linked to social demands or constructs. The thoughtful interest is in establishing the relationship between the construction that the subject makes of the norm and the pedagogical dynamics that are presented within the educational institution. Methodological design was chosen for a hermeneutic approach, which aims to approximate the social through the specific recognition of the subjects in their contexts of interaction, their stories, their attitudes, practices and awareness in front situations in relation to others; with a qualitative method through a case study. The techniques used were the semi-structured interview and the focus group and tools used were the interview guide and the questionnaire. Among the results or findings that give an account of the significance that students of the Ciudad Don Bosco Education Center have of the norm and its relations with it - as a statement and mandate that regulates, sanctions and sets behavior guidelines - it is found that they conceive of the standard as legitimate as long as it ensures respect for the difference, even if there may be contradictions in practices and attitudes regarding the rules they consider legitimate; In the meantime, the rule is illegitimate when it reduces the options of autonomy in the young and, although there is a recognition of the legal norm, it is also recognized that it is susceptible to transgression, especially when a particular interest prevails. As for the construction of the standard, they consider that it has been the domain of adults and the participation of young people is little or no, which would raise suspicions of some illegitimacy, since they were not taken into account. The pedagogical function necessarily goes through questions and reflections about the cohabitation at the school space; there it becomes evident the relationship between genrecions a matter of power and, the discipline and sanctions appear as ways to take the rule. Finally, young people outline proposals a tendency to build or recognize ethical and moral subjects, which are preparing for participation in collective life
