El primero establece la igualdad formal al manifestar que todas las personas nacen libres e iguales ante la Ley, el segundo protege a la familia como núcleo esencial de la sociedad y a quienes la integran, el último hace acepción directa a la necesidad de garantizar la equidad de género. En virtud de estos mandatos comienza una nueva era en la protección de la mujer contra todas las formas de discriminación, incluyendo la violencia intrafamiliar como forma de perpetuación de la opresión femenina en el ámbito privado, posibilitando la apertura de un progreso legal en materia de prevención, eliminación y protección de la violencia de género, que tuvo punto hito en la promulgación de la Ley 1257 de 2008.
- PublicaciónAcceso abiertoAnálisis de las medidas adoptadas por la OEA en Honduras tras el golpe de estado año 2009(2018-09-25) Ospino Arteta, Melissa Margarita; Morón Campos, Miguel AntonioIn November 2016, the University of San Buenaventura Cartagena, represented by a group of students, made the academic route to the United States where the United Nations Organization and the Organization of American States are located in order to know the functioning of their structure and the importance of the influence of these organizations in the region, in addition to broadening and deepening the knowledge acquired from the academy so that contributions on international rights can be made. Given the above, the personal motivation of the author was generated by knowing and analyzing the processes in the application of the democratic charter as an instrument that safeguards democracy in the countries of the American organization, that is why the country was taken as reference of Honduras, specifically the case of the coup d'état in June 2009, since it has different origins and causes of the constitutional rupture compared to other countries, besides being the most recent case of the region. Therefore, this paper presents issues related to the causes, consequences and efficiency of the measures adopted by the OEA, to achieve the restoration of the democratic system in Honduras; all this in order to build an exhaustive analysis on the measures implemented by said organization for the referenced case.

(United Nations Organization, s.f). The right to life is a fundamental pillar for the Inter-American Human Rights System (hereinafter IAHRS) and for domestic law in all States Parties, as it represents the prerequisite for the enjoyment of other rights and is directly related to a essential part of every person: human dignity.
- PublicaciónAcceso abiertoGarantías de protección para el trabajo sexual lícito derivadas de la confianza legítima prevista en la jurisprudencia constitucional(2018-06-18) Mallarino Peinado, Anyuris; Blanquiceth Ortiz, Leonela; Villegas Tamara, DonaldoLas relaciones entre la administración pública y los administrados están mediadas por la buena fe y el respeto al marco constitucional y legal colombiano, lo que supone una actuación ejemplar y ajustada a derecho de ambos, de tal manera que si el primero rompe abruptamente con las expectativas que el segundo se ha creado y que fueron consentidas por aquel, generando una desestabilidad evidente e inesperada que afecte el interés público y el del particular, se ha vulnerado el principio de confianza legítima. Este principio, aunque no está expresamente consagrado en la ley, ha permitido dirimir muchos conflictos y generar garantías de protección en escenarios de violación de derechos; entre los problemas resuelto por la jurisprudencia constitucional, está uno en el que un establecimiento, donde se ejercía el trabajo sexual lícito, fue desplazado arbitrariamente por la administración municipal, pese a que existía entre ellos un convenio sobre el plazo de desocupación, lo que representó, a juicio del alto tribunal, un comportamiento desproporcionado e irrazonable del ente territorial, y permitió abrir la puerta a las garantías de protección para el trabajo sexual lícito derivadas de la confianza legítima.

Y C(2018-09-28) Lozano Escorcia, Yon Jader; Meléndez Cuentas, Eucaris Isabel; Acosta Castro, Juan GabrielThe Bazurto market, Cartagena's main supply center, as well as all the market places, produces large volumes of solid waste, which contribute to environmental pollution and the environmental deterioration of the sector, given the effect of the air due to bad odors generated by the contamination of solid organic waste, landscaping, water by the discharge of these to the sewerage system, which has a negative impact on communities, given that they cause health problems and deteriorate their standard of living. This environmental problem, caused by pollution from the mismanagement of solid waste, involves communities and political decisions, which are often controversial and therefore very difficult to resolve, however a responsibility and knowledge must be assumed. the possibilities that exist to protect and improve the environment. According to Durán (sf), in a study carried out by ECLAC (Environmental Policies and Sustainable Development), the main actors of the waste policy are the government, businessmen and the population, the latter being the most determining , due to its demands for a better quality of life, which forces governments and businessmen to seek7 solutions to problems, based, today, on legal aspects where a regulatory framework is established with laws, regulations and norms that regulate the behavior of the economic agents and of the population and at the same time the control and supervision activities of public institutions with some responsibility in this matter
- PublicaciónAcceso abiertoLa noción de víctima a la luz de la jurisprudencia de la corte interamericana de derechos humanos(2018-06-14) Molina González, Yosimar; Acosta Castro, Juan GabrielThe victims throughout history have been at the center of the world debate, in which the defense of them has been promoted through the promulgation of normative instruments and the strengthening of judicial institutions for the sanction of the States. Thus, in the resolution of legal problems, the Inter-American Court of Human Rights (hereinafter IACHR), as an international judicial tribunal legitimized to apply and interpret the American Convention on Human Rights, has conceived that the concept of victim implies an injury of human rights by the States Parties, recognized in a judicial decision; conception that has transcended the recognition of relatives as indirect victims, under the assumption of the functional balance between the exercise of power and the guarantees of obligations, both negative and positive of the States, for individuals and for entire populations. From this perspective, in the present work the conception of collective victims will be addressed from the jurisprudence of the IACHR, and for that purpose an analysis of the judgments that this Court has issued on the subject will be made, reviewing what has been said about it and the evolution in its conception.
