- PublicaciónAcceso abiertoAnálisis de los riesgos laborales y ambientales del transporte marítimo de hidrocarburos en Colombia(2014) Rocha Gomez, Tania; Caraballo Payares, AlexanderThis article seeks to outline the various labor and environmental hazards encountered in the maritime transport of hydrocarbons in Colombia, the relevance in this constant use of maritime activity, as well as the positive involvement of hydrocarbons in the life of man is established, but on the other hand, and with a high degree of concern a number of occupational hazards and environmental impact that not being handled properly can cause a major disaster on marine and terrestrial biota, so preventive strategies are discussed arise to control and minimize both labor and environmental incidents, one of the tools involved is representing occupational health or safety of workers handling these vessels. This work is theoretical and reflective type and is based on a documentary and descriptive study, with both texts and specialized reports, theses and refereed journals. The analysis of labor and environmental maritime transport of hydrocarbons in Colombia risks, makes evident the current problems of the whole process that is subject to this trade by ship from the port to the start point of arrival, both the environment external (environmental) and internal (working environment).
- PublicaciónAcceso abiertoLa carga dinámica de la prueba dentro del proceso contractual de transporte marítimo bajo conocimiento de embarque(Universidad de San Buenaventura, 2013-06) Morales Aragón, Johanna AlejandraEste artículo forma parte de una investigación que tiene como objetivo el análisis de la carga dinámica de la prueba en los contratos de transporte marítimo de mercancías, bajo la modalidad de conocimiento de embarque y según lo estipulado en el nuevo Código General del Proceso que rige hoy en Colombia. Asimismo, hace un recorrido por las legislaciones nacionales e internacionales que regulan este tipo de acuerdos, los pronunciamientos de la Corte Constitucional y las opiniones de los tratadistas, todo ello con el fin de confrontar la funcionalidad del documento denominado conocimiento de embarque o Bill of Lading (B/L, por sus iniciales en inglés) y la importancia probatoria que tiene. Posteriormente, se hará una propuesta encaminada a la solución de los problemas encontrados.

Hoy el mundo tiembla ante un agente infeccioso conocido como Coronavirus (COVID-19) el cual es una evolución del virus del síndrome respiratorio agudo severo tipo-2 (SARS-CoV-2), el COVID-19 tiene su origen en China, en la ciudad de Wuhan, provincia de Hubei. Esta infección ha llevado a la muerte a millones de personas y ha generado una crisis económica mundial. Las exportaciones e importaciones de mercancías en el mundo han tenido cambios en toda su logística, como bien sabemos el transporte marítimo es el pilar más fuerte del comercio internacional por ser el más utilizado al transportar mercancías, de hecho, según la Conferencia de las Naciones Unidas sobre Comercio y Desarrollo, la carga marítima maneja más del 90% del comercio mundial por volumen y más del 70% por valor y este ha tenido Cambios en sus tarifas, volúmenes y en algunas restricciones debido al COVID-19, por lo cual es importante conocer los efectos que se produjeron en el transporte marítimo de mercancías en Latinoamérica debido al Coronavirus Covid-19 desde su etapa inicial en la región a principios de 2020 hasta finales del año 2021. Debido a lo anterior, el propósito de ésta investigación es identificar los efectos que ha generado el Coronavirus en este sector de la economía y los cambios a los cuales se han sometido las organizaciones de logística marítima para solventar los problemas en la cadena de suministro.
