La noción de víctima a la luz de la jurisprudencia de la corte interamericana de derechos humanos

Abstract
The victims throughout history have been at the center of the world debate, in which the defense of them has been promoted through the promulgation of normative instruments and the strengthening of judicial institutions for the sanction of the States. Thus, in the resolution of legal problems, the Inter-American Court of Human Rights (hereinafter IACHR), as an international judicial tribunal legitimized to apply and interpret the American Convention on Human Rights, has conceived that the concept of victim implies an injury of human rights by the States Parties, recognized in a judicial decision; conception that has transcended the recognition of relatives as indirect victims, under the assumption of the functional balance between the exercise of power and the guarantees of obligations, both negative and positive of the States, for individuals and for entire populations. From this perspective, in the present work the conception of collective victims will be addressed from the jurisprudence of the IACHR, and for that purpose an analysis of the judgments that this Court has issued on the subject will be made, reviewing what has been said about it and the evolution in its conception.

Las víctimas a lo largo de la historia han estado en el foco del debate mundial, en el cual se ha promovido la defensa de ellas a través de la promulgación de instrumentos normativos y el fortalecimiento de Instituciones judiciales para la sanción de los Estados. Es así como en la resolución de problemas jurídicos, la Corte Interamericana de Derechos Humanos (en adelante Corte IDH), como un tribunal judicial internacional legitimado para aplicar e interpretar la Convención Americana de Derechos Humanos, ha concebido que el concepto de víctima implica una lesión de derechos humanos por parte de los Estados Partes, reconocido en sentencia judicial; concepción que ha trascendido al reconocimiento de familiares como víctimas indirectas, bajo el supuesto del equilibrio funcional entre el ejercicio del poder y las garantías de las obligaciones, tanto negativas como positivas de los Estados, para los individuos como para poblaciones enteras. Desde esta perspectiva, en el presente trabajo se abordará la concepción de víctimas colectivas desde la jurisprudencia de la Corte IDH, y para tal efecto se hará un análisis de las sentencias que ha proferido este Tribunal sobre el tema, revisando lo que ha dicho al respecto y la evolución en su concepción.
