Abstract
It is clear that each State has the power to create, organize, delegate and / or define institutions that are aimed at fulfilling its principles, duties and constitutional obligations and, in this way, guarantee the rights to which its partners take place. This research has relevance within the Colombian legal system, since it is necessary to identify and analyze the effectiveness of public policies in the municipality of Santiago de Cali for the fulfillment and guarantee of the right to recreation in the population Childhood, understood as a fundamental right, progressive compliance and that will impact on the formation of the personality, character and integral education of the children of Cali. Some people in our Region assume Recreation as something superfluous and trivial that does not correspond to the socially essential and that therefore should not be within the priorities of the state, but in the field of the individual problem of the search for options for Recreation and the use of free time, play an important role in the daily life of the population and in the possibilities of human and social development, contrary to this, there is a formal recognition at the international and national level of the Recreation as a right and a fundamental need, and by virtue of it, it is the responsibility of the State to enable the population to access and enjoy it. In addition to this, the need to compare the growth or decrease in the execution of the right that is the subject of the investigation within the two previous municipal administrative periods, will allow us to have clear and conclusive figures of how the State through entities in which it delegates the realization of the same, has been able to generate expansion and greater coverage in the subjects of protection. In addition to this, it is necessary to clarify that we have the necessary information and documentation, first-hand sources and analysis of the budget items approved by the council of Santiago de Cali to respond to the approach of the problem.

Es claro que cada Estado tiene la potestad de crear, organizar, delegar y/o definir instituciones que se encuentren encaminadas al cumplimiento de sus principios, deberes y obligaciones Constitucionales y así, de esta manera garantizar los derechos a los que sus asociados tengan lugar. La presente investigación tiene relevancia dentro del ordenamiento jurídico legal colombiano, toda vez que es necesario identificar y analizar cuál ha sido la eficacia de las políticas públicas en el municipio de Santiago de Cali para el cumplimiento y la garantía del derecho a la recreación en la población infantil, entendido este como un derecho fundamental, de cumplimiento progresivo y que repercutirá en la formación de la personalidad, carácter y educación integral de los niños y niñas caleños. Algunas personas de nuestra Región asumen la Recreación como algo superfluo y trivial que no corresponde al ámbito de lo socialmente esencial y que por tanto no debe estar dentro de las prioridades del estado, sino en el terreno del problema individual de la búsqueda de las opciones para disfrutarla, en toda sociedad la recreación y el aprovechamiento del tiempo libre, desempeñan un papel importante en la vida cotidiana de la población y en las posibilidades de desarrollo humano y social, contrario a esto, hay un reconocimiento formal a nivel internacional y nacional de la Recreación como derecho y necesidad fundamental, y en virtud de éste le corresponde al Estado la responsabilidad por viabilizar a la población el acceso y disfrute a la misma. Además de esto, la necesidad de comparar el crecimiento o decrecimiento de la ejecución del derecho objeto de la investigación dentro de los dos periodos administrativos municipales inmediatamente anteriores, nos permitirán tener cifras claras y contundentes de como el Estado a través de entidades en las que delega la realización del mismo, ha podido generar expansión y mayor cobertura en los sujetos de protección. Aunado a esto es necesario aclarar que se cuenta con la información y documentación necesaria, fuentes de primera mano y análisis de las partidas presupuestales aprobadas por el concejo de Santiago de Cali para dar respuesta al planteamiento del problema.
