Abstract
In this investigation we wanted to analyze if the Colombian legislation had a gender approach to it directed towards the creation of enterprises, as the advances in a legal, technical and commercial matter with the purpose of studying which are the main obstacles that the small and medium size enterprises lead by women in Valle del Cauca. It was determined if there are in Colombia any regulations with a gender approach that allows women to regain a bit of leadership in society. To accomplish this goal a legal trace was made and the request of information to different state units, all of the information gather was analyzed through two very important representatives of the feminist theory, Iris M. Young (2000) and Rosa Cobo (2005).

Dentro de artículo se pretendió analizar si la legislación Colombiana contiene un enfoque de género dirigido hacia la creación de empresa, al igual que sus avances en materia jurídica, técnica y comercial a fin de estudiar cuáles son los principales obstáculos que asumen las PYMES conformadas por mujeres emprendedoras en el Valle del Cauca. Se determinó si en Colombia existe normatividad con enfoque de género que le permita a la mujer recobrar un poco de protagonismo en la sociedad. Para lograr este objetivo se realizó un rastreo legislativo y la solicitud de información a entidades estatales, se analizó toda la información obtenida a través de dos importantes representantes de la teoría feminista crítica, Iris. M. Young (2000) y Rosa Cobo (2005).
