La pensión anticipada de vejez por deficiencia física, psíquica o sensorial del 50% o más: obstáculos administrativos y soluciones jurisprudenciales para su reconocimiento

Abstract
The article 9th of Law 797 of 2003 offers an advanced old-age pension for people who suffer a physical, psychological or sensory deficiency of 50% or more, who are 55 years of age or older and have 1,000 or more weeks quoted to the pension system. This rule presents problems in his application because the redaction generates many interpretations. The principals obstacles are attributed to the criterion of “deficiency”, according to the Manual for the qualification of the Loss of Labor and Occupational Capacity, as well as the silence that was kept in front of the origin that must have whoever that requires the benefit of the prestation. In this elaboration, it’s studied the normative framework of the pension alluded and it’s analyzed the range that the jurisprudence of the Constitutional Court of Colombia has given to the precept that consecrates.

El artículo 9° de la Ley 797 de 2003 ofrece una pensión anticipada de vejez para “las personas que padezcan una deficiencia física, síquica o sensorial del 50% o más”, que cuenten con 55 años o más de edad y que tengan 1.000 o más semanas cotizadas al sistema pensional. Esa norma presenta problemas en su aplicación porque la redacción genera varias interpretaciones. Los principales obstáculos se atribuyen al criterio de “deficiencia”, conforme al Manual para la Calificación de la Pérdida de Capacidad Laboral y Ocupacional, así como también al silencio que se guardó frente al origen que debe tener el padecimiento de quien requiere la prestación. En este trabajo se estudia el marco normativo de la pensión aludida y se analiza el alcance que la jurisprudencia de la Corte Constitucional Colombiana le ha dado al precepto que la consagra.
