Abstract
The article presents a synthesis of the main aspects that must be taken into account when analyzing, interpreting and applying the legal simulation in relation to the crime of falsehood in a private document, including both the jurisprudential positions and that of the main Colombian or foreign doctrine writers as Bernate Ochoa, Acosta Madievo, Tapias, Baquero, among others. In addition, it makes a journey from its antecedents, going through its conceptualization, location, classification and current regulation, until arriving at the effects that it produces; Analyzing in the same way, rulings that have been uttered by the Supreme Court of Justice of our country in relation to this issue. Before addressing these institutions, the article will explain the theory of the differential association hypothesis elaborated by Sutherland (1940) in his book White Collar Crimes, where the author distorted the classic criminal theories that associated criminal acts with people of low resources and other pathologies like the lack of education and recreation. The author explains with his theory that it is not relevant the socioeconomic status to evidence the criminal behavior of people, but that you are learned to commit a crime according to the favorable or unfavorable definition that they gave to certain behaviors.

El artículo presenta una síntesis de los principales aspectos que deben tenerse en cuenta al momento de analizar, interpretar y aplicar la simulación jurídica en relación al delito de falsedad en documento privado, recoge tanto las posturas jurisprudenciales como la de los principales doctrinantes colombianos o foráneos tales como Bernate Ochoa, Acosta Madievo, Tapias, Baquero, entre otros. Además, hace un recorrido desde sus antecedentes, pasando por su conceptualización, ubicación, clasificación y reglamentación actual, hasta llegar a los efectos que produce; analizando de igual manera, fallos que ha proferido la Corte Suprema de Justicia de nuestro país en relación a este tema. Antes de abordar estas instituciones el artículo explica la teoría de la hipótesis de asociación diferencial elaborada por Sutherland (1940) en su libro los delitos de cuello blanco, donde el autor desvirtuó las teorías criminales clásicas que asociaban los hechos criminales con las personas de bajos recursos y otras patologías como la falta de educación y recreación. El autor explica con su teoría que no es de relevancia el estatus socioeconómico para evidenciar el actuar delincuencial de las personas, si no que estás aprendían a delinquir según la definición favorable o desfavorable que le daban a ciertos comportamientos
